This is an English translation. The Japanese version governs these Terms, except where mandatory local law requires otherwise.

These Terms of Service (the "Terms") set out the conditions for using "Komadori for VRChat" (the "Service"), which is provided by Destingate LLC (Destingate合同会社, "we", "us" or "our"). Everyone who uses the Service ("you" or "users") must agree to these Terms before using it.

The Service is an unofficial service and has no affiliation with VRChat Inc. VRChat is a trademark of VRChat Inc.

Article 1 (Application and Definitions)

  1. These Terms apply to every aspect of the relationship between us and you in connection with your use of the Service.
  2. In these Terms, the following words have the meanings below.
    • "Service": the whole of Komadori for VRChat that we operate, including the website (Komadori), the API, and the resident tool.
    • "Resident tool": software that runs on your Windows PC, reads VRChat's output log, and sends the videos it records to the Service.
    • "Post": registering, together with the time and other details, the video you send to the Service (3 seconds, no audio; this includes a simultaneously recorded selfie video), the poster image generated automatically from the video, the world name, a caption and other information (together, "Post Content").
    • "Friends" and "Groups": relationships and sets of users, formed through a friend code or an invite code in the Service, that define who can see your Posts.
  3. Individual rules and guides that we publish in the Service or on our website form part of these Terms.
  4. Our handling of personal information in the Service is governed by the separate Privacy Policy.

Article 2 (Agreement to These Terms, Age, and Minors)

  1. You are deemed to have agreed to these Terms and the Privacy Policy when you log in to the Service, or when you press a button that starts use as a guest (for example, "Start without logging in", "Join without logging in", "Become friends without logging in", or "Start (no login needed)"). Merely opening an invite link or similar does not count as agreement.
  2. If you are under 16, you may not use the Service. By logging in or by taking an action that starts use as a guest, you are deemed to declare that you are 16 or older. Age is confirmed by your own declaration only; we do not collect your date of birth.
  3. If you are 16 or older but under 18, please use the Service only after you have understood these Terms.
  4. You must also comply with VRChat's Terms of Service and other rules set by VRChat.

Article 3 (Accounts)

  1. You use the Service by logging in with a Discord account or a Google account (you can link both. A Discord or Google account that is already used by another account cannot be linked. We do not merge separate registered accounts). As a trial, you can also start as a guest without logging in. You must manage your accounts at your own responsibility, in accordance with the terms of Discord and Google.
    • A guest can use the Service within the limits we set (currently: up to 3 Posts in total, up to 3 Groups that the guest can create, and no morning announcements to Discord (webhook), among others). After reaching a limit, you can continue by registering with Discord or Google. If the account you register with already exists, we merge the guest's data into that account (duplicate content, such as Posts for the same day and slot, is not merged).
    • Other users also see that you are a "Guest".
    • If a guest account is not used for 30 days after its last use, we delete it, including its Post Content (a registered account is deleted after 1 year without use; see Article 6). If you disconnect the resident tool or log out while still a guest, you may no longer be able to return to that account.
    • To prevent abuse such as mass creation of guests, we limit the number of creations using a hash value created from IP addresses (see the Privacy Policy).
  2. You must be entitled to use the Service with your own Discord account or Google account.
  3. One user must not create multiple accounts (including guests) to misuse the Service's mechanisms (such as voting, trial limits, or how notification times are handled), or to evade a suspension or a block.
  4. You must not let any third party use your account or your device connection, and must not lend or transfer them. You bear any loss caused by inadequate management of your account, except where we act intentionally or with gross negligence.
  5. You can delete your account yourself at any time from the "Account" screen in the app (to confirm, you must type the confirmation text shown on the screen). When you delete it, your Post Content, votes, and links to Friends and Groups are deleted immediately and cannot be restored. You can also export your own data as JSON from within the app. If you cannot do this in the app, contact us at the address in Article 20. After confirming your identity, we will delete the account within a reasonable period.

Article 4 (What the Service Offers)

The Service lets VRChat users post a 3-second video of their VRChat screen in response to notifications that arrive every hour and once a day, and share and view that day's record among Friends and Groups. The main features are the hourly 3-second recording, the once-a-day simultaneous "NOW!" (a 3-second video; in Japanese, "今だ!"), the day's log, the day's title, badges, and voting in Groups. Members of your Friends and Groups can also view the record of days on which you did not post. The Service is free of charge.

Article 5 (What the Resident Tool Does)

  1. The resident tool operates only within the following scope.
    • From VRChat's output log, it reads your own VRChat display name and user ID, the current world (name and ID), and the fact that the VRChat camera shutter was pressed. It does not use screenshot images saved by VRChat for Posts. The shutter is used only as the trigger to start recording.
    • Only when you press the VRChat camera shutter after a notification, it records the VRChat window for 3 seconds from that moment. "NOW!" is likewise a 3-second recording. However, if you turn on the setting "Record automatically 5 seconds after the notification" (off by default), it records 5 seconds after the notification without waiting for the shutter. Recordings contain no audio. If you have the setting enabled (enabled by default), it also records the VRChat camera feed (Stream) during the same 3 seconds (no audio; the "selfie") and sends it together with the screen video. Depending on where the camera points, a selfie may show other users' avatars or names. You can turn selfies off in the settings at any time, and if a selfie cannot be captured, only the screen video is posted.
    • It sends the recorded video (the Service generates the poster image from the video automatically), the capture time, and, unless you turned it off in the settings, the world name and world ID, to the Service.
    • Recorded files are kept in a temporary location on your PC until they are posted, and are deleted after posting, after being discarded, after the deadline has passed, and so on (see Article 5 of the Privacy Policy for details). Even after a trial guest has used up the number of Posts allowed, the resident tool continues to record, and may keep that day's recordings on your PC until you register. They are deleted when the day changes.
  2. The resident tool does not send VRChat's instance ID (who you are with and where). It also does not use VRChat's unofficial API.
  3. The resident tool does not collect, store, or send your VRChat password or Discord password.

Article 6 (Rights and License for Post Content)

  1. Copyright and other rights in Post Content remain with whoever holds them. We do not acquire rights in Post Content.
  2. You grant us a free license to store, copy, resize or otherwise technically process Post Content, and to display and play it to members within the sharing scope you set in the Service, to the extent necessary to provide, operate, maintain, and improve the Service. This license is non-exclusive and lasts for as long as the Post Content exists on the Service.
  3. We do not make Post Content public to anyone other than you for advertising, promotion, or any other purpose, unless you separately agree.
  4. You warrant that you are entitled to grant the license in the preceding paragraph for your Post Content.
  5. Posted videos and their poster images (including selfies) are stored in the Service while your account exists. They are deleted when you delete a clip yourself or delete your account. A registered account that has not been used for 1 year after its last use is deleted, including its Post Content (if you have notifications turned on, we notify you about 30 days before deletion; opening the app lets you keep the account). Guest deletion is as described in Article 3. For operational reasons such as cost, capacity, or safety, we may shorten how long Post Content is stored, in which case we will tell you in advance. We have no obligation to restore deleted content from backups.

Article 7 (Consideration for Other Users, Avatars, and Worlds)

In VRChat, other users, avatars, and world creators have rights and terms of use. VRChat's Terms of Service (including Section 13.2(c)) also prohibit sharing other users' content without permission. For this reason, you must follow these rules.

  1. When you post a video (including a selfie) that shows another user (including their avatar or name), you are responsible for getting that user's consent beforehand.
  2. You must not film or record in worlds, events, instances, or other places or situations where filming or recording is prohibited. The same applies if someone refuses to be filmed or recorded.
  3. Check the terms of use for avatars and worlds (such as whether filming is allowed, and limits on streaming or publishing) and follow them.
  4. If a person who appears in a video asks you to delete it, respond in good faith, for example by promptly deleting the Post.

Article 8 (Prohibited Acts)

When using the Service, you must not do any of the following.

  1. Acts that violate laws or public order and morals, or that encourage such acts.
  2. Acts that infringe another person's copyright, portrait rights, privacy, reputation, or other rights or interests.
  3. Posting anything that depicts or suggests children in a sexual way (including avatar depictions), or any other act involving the sexual exploitation of children.
  4. Posting sexual images or videos without the consent of the person shown (including so-called revenge porn).
  5. Posting obscene content, excessively violent or cruel content, or other content that offends other users.
  6. Harassing, defaming, threatening, discriminating against, stalking, or doxxing other users.
  7. Impersonating another person, or registering false information.
  8. Contrary to Article 7, posting content filmed in places or situations where filming or recording is prohibited or has been refused.
  9. Acts that violate VRChat's Terms of Service or other rules.
  10. Analyzing the source code or communications of the Service, reverse engineering, or decompiling it (except where permitted by law).
  11. Unauthorized access to the API, placing excessive load on it, guessing notification times, bypassing authentication, or other attempts at abuse, including using automated programs for those purposes (other than the resident tool we provide).
  12. Reposting other people's videos or images, posting video other than VRChat screens, or any other Post that does not fit the purpose of the Service.
  13. Acts that interfere with the operation of the Service or with other users' use of it.
  14. Providing benefits to antisocial forces, or acts equivalent to this.
  15. Any other act that we reasonably judge to be inappropriate.

Article 9 (Confidentiality of Communications)

The Service mediates the sharing of records that users do within a limited sharing scope. We comply with the Telecommunications Business Act and other applicable laws, and respect the confidentiality of users' communications. Except where required by law, or to the extent necessary for legitimate operations such as handling reports under these Terms, investigating misuse, and responding to failures, we do not view, use, or provide Post Content to third parties.

Article 10 (Reports and Removal)

  1. If you believe Post Content violates Article 7 or Article 8 or infringes rights, you can report it from "Report" in the "⋯" menu of the Post in the app, by choosing a reason. A reported Post is immediately hidden from the person who reported it. If you cannot report in the app (for example, a person who appears in a video but does not use the Service), contact us at the address in Article 20. Please include the Post concerned (date, time, and poster) and the reason in your report.
  2. When we receive a report, or ourselves notice a possible violation, we check the facts. To do so, we may review the Post Content concerned, to the extent necessary.
  3. We may delete or hide, without prior notice, Post Content that we reasonably judge may violate these Terms or infringe rights.
  4. We will endeavor to respond promptly to legitimate removal requests from rights holders and from people who appear in videos.
  5. We have no obligation to monitor Post Content at all times.
  6. Using "Block" in the app, you can make it so that you and a specific user do not see each other's Posts. When you block someone, the friend relationship and any friend request are ended, and even if you are in the same Group, you do not see each other's Posts. The other person is not told that you blocked them. You can unblock at any time from the "Account" screen in the app.
  7. In response to a report, we may delete the reported Post or suspend the user who made it. To check that our responses are appropriate and to prevent recurrence, we keep records of reports and of our responses for a certain period (1 year from the response for both).

Article 11 (Suspension and Deregistration)

  1. If we judge that you fall under any of the following, we may, without prior notice, delete Post Content, suspend your use of the Service, or delete your account.
    • You have violated these Terms.
    • Your registration information was false.
    • There has been no use for a long time and we consider action necessary.
    • We otherwise reasonably judge that continued use of the Service is inappropriate.
  2. You can stop using the Service at any time. Account deletion follows the procedure in Article 3, paragraph 5.

A suspended account cannot use the Service's features, and Post Content of that account is not shown to other users.

  1. We are not liable for loss you suffer due to the measures in the preceding paragraphs, except where we act intentionally or with gross negligence.

Article 12 (Changes, Interruption, and End of the Service)

  1. We may change the content of the Service or temporarily interrupt it without prior notice to you. This includes cases caused by maintenance, failures, faults of carriers or cloud services, natural disasters, and other reasons.
  2. After giving reasonable notice on our website or elsewhere, we may end all or part of the Service. If we do, we will endeavor to give a reasonable period for you to retrieve or delete data.
  3. The Service is currently provided free of charge. We may add paid features or plans in the future. In that case, the fees, payment methods, cancellation, and other terms will follow separate terms. We will tell you in advance if we add paid features.

Article 13 (Relationship with VRChat and External Services)

  1. The Service is an unofficial service with no affiliation with VRChat Inc., and is not approved, partnered with, or sponsored by VRChat Inc.
  2. The Service depends on VRChat's specifications (such as the log format) and on the specifications and availability of external services such as Discord and Cloudflare. Changes or failures in these may make all or part of the Service unavailable.
  3. We are not liable for any disadvantage you suffer in connection with your use of the Service because you violated VRChat's Terms of Service or other rules (including suspension of your VRChat account), except where we act intentionally or with gross negligence.

Article 14 (Intellectual Property)

Copyright and other intellectual property rights in the Service (including the name, logo, software, and screen design, but excluding Post Content) belong to us or to those who license them to us. We grant you a non-exclusive, non-transferable, non-sublicensable right to use the Service in accordance with these Terms.

Article 15 (Disclaimer of Warranties)

We do not give any warranty, express or implied, that the Service is fit for a particular purpose, has the functions, accuracy, usefulness, or continuity you expect, is free of defects or errors, or does not infringe the rights of third parties. Notifications may not arrive, notification times may be delayed, and recording may fail. However, this disclaimer does not apply where we act intentionally or with gross negligence, and it does not limit the next Article.

Article 16 (Disclaimer and Limitation of Liability)

  1. We are not liable for loss you suffer in connection with the Service, except where we act intentionally or with gross negligence.
  2. Notwithstanding the preceding paragraph, where the contract between us and you concerning the Service is a consumer contract under the Japanese Consumer Contract Act, for loss you suffer because of our default or tort (other than gross negligence), we are liable only for direct loss that would ordinarily arise.
  3. Even in the case of the preceding paragraph, we are not liable for loss arising from special circumstances (except where we foresaw or could have foreseen them), lost profits, or indirect loss.
  4. We are not liable for loss or disputes arising from other users' Post Content, communications, or acts that are not attributable to us. You are to resolve them at your own responsibility and expense.

Article 17 (Your Responsibility)

If we suffer loss because of your use of the Service (including Post Content), or if a third party makes a claim or complaint against us, and the cause is your intentional or negligent act, you will bear that loss and related expenses (including reasonable attorneys' fees).

Article 18 (Changes to These Terms)

  1. In either of the following cases, we may change these Terms without your individual consent, under Article 548-4 of the Japanese Civil Code.
    • The change is in the general interest of users.
    • The change does not run counter to the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content, whether this clause exists and what it says, and other circumstances relating to the change.
  2. If we change these Terms, we will inform you, a reasonable time before the effective date, that the Terms will change, what the changed Terms say, and the effective date, by posting on the Service's website or by another appropriate method.
  3. If you use the Service on or after the effective date, you are deemed to have agreed to the changed Terms. If you do not agree, you can stop using the Service and ask for your account to be deleted under Article 3, paragraph 5.

Article 19 (Severability and Assignment)

  1. If any part of these Terms is found invalid or unenforceable, the remaining parts continue in effect.
  2. You may not assign your position, rights, or obligations under these Terms to a third party without our prior written consent (including by electronic means).

Article 20 (Contact)

Please send inquiries about the Service, reports, account deletion requests, and removal requests to the following contact. We accept both Japanese and English.

Article 21 (Governing Law and Jurisdiction)

  1. These Terms are governed by, and interpreted under, the laws of Japan.
  2. If a dispute arises between us and you in connection with the Service, the district court that has jurisdiction over the location of our head office is the exclusive court of first instance by agreement. However, where jurisdiction set by the Consumer Contract Act or other law takes priority, that provision applies.
  3. Notwithstanding the preceding two paragraphs, where mandatory consumer-protection law of the country or region where you live as a consumer applies (including rules on governing law and jurisdiction), this Article does not affect the application of that mandatory law.

Article 22 (Language)

The Japanese version of these Terms governs. Translations such as the English version are provided for reference, and if there is any difference in content, the Japanese version prevails. However, where mandatory law of the country or region where you live provides otherwise, that provision applies.
